Arresting Citizens For “Insulting” President Is Unconstitutional And Will Be Challenged By Tope Akinyode

The arrest of a 70-year-old man and two others for “insulting” President Muhammadu Buhari and governor of Katsina State is unconstitutional and therefore condemnable.
The point has to be made that defamation (whether civil or criminal) is private or personal in nature and public officers or government agencies are barred by law from suing for defamation. 
In the case of Omega Bank Plc V Government of Ekiti State (2007) 16 NWLR (PT. 1061) 445 AT 478 – 479 PARA. E (CA), the court held that “…in view of the personal nature of libel actions, public officers have no right to sue or be sued for libel. In the instant case, the respondent being public officers had no right of action in libel”.

The idea that an organ of government or public officers cannot sue for defamation is premised on the ground that state resources must never be deployed against citizens to intimidate them into silence. In Omega Bank Plc V Government of Ekiti State (Sic) the court established that, “An organ of government, that is the state or a governmental department which has corporate status may not sue for defamation. This is based on the premise that it would be a serious interference with the freedom of expression of opinion as guaranteed under section 39 of 1999 constitution if the wealth of the state derived from the state’s subjects could be used to launch against those subjects for defamation because they have, falsely and unfairly as it may be, criticised or condemned the management of the country. If a right of action is granted to the government/public officer to maintain an action in libel, the constitutionally guaranteed freedom of expression will be curtailed. Thus, in the instant case, the respondents lacked the locus standi to maintain an action in the tort of defamation”. This position of law was also reinforced in U.B.N. Ltd v Oredein (1992) 6 NWLR (Pt. 247) 355.
Moreover, the court held thus: “It will be against the public interest for government/public officers to use the tax paid by the people to institute actions against them in libel. If right of action is granted to the government /public officers to maintain an action in libel.” the constitutionally guaranteed freedom of expression will be curtailed.” The justifiability of libel actions at the instance of public offices and public institutions and the desirability of allowing public institutions/bodies to use tax payers’ money to fund libel actions against the very same tax payers were issues which were determined.
It is sad to note the rising spate of intolerance of public officers. The fact remains that in 2018, President Buhari declared that Nigerian youth are lazy, uneducated and wanting everything free. Nobody sued the President for defamation. How come government agencies are quickly launching defamation suits these days?
Against the foregoing, I hereby give the Nigeria Police Force an ultimatum of 24 hours to release the three persons arrested for “insulting” the President and governor of Katsina State. Otherwise, I shall approach the court to determine the constitutionality of the act and to enforce the fundamental human right of the victims.

The Central Bank of Nigeria have suspended the ongoing staff layoffs by some banks in the country.
The apex bank said in a statement that the decision was taken after a special meeting of the Bankers’ Committee.
SaharaReporters had reported how a pregnant cashier at the Ketu branch of Access Bank collapsed on Saturday after hearing of her sack by the bank.

Access Bank had announced plans to sack its workers as a result of the negative impact of the Coronavirus outbreak.
According to the statement by the CBN Director of Corporate Communications, Mr Isaac Okoroafor, on Sunday, it was also agreed that banks would need the express approval of the apex bank to lay off any staff.

BREAKING: Mysterious Deaths Recorded In Kano Caused By Coronavirus, Says Presidential Task Force Committee

Dr Nasiru Sani Gwarzo, leader of the Presidential Task Force Committee on COVID-19, has said that the virus was the cause of the mysterious deaths recorded in Kano State in recent days. 
Gwarzo, who spoke on Sunday, said the recent deaths from the test carried out established that COVID-19 was the cause.
He said, “Let me inform us that most of the deaths recorded of recent and test carried out showed that Coronavirus was the cause. 

“So, before the final report which would be ready in the next one week or few days, it is necessary for people of Kano to wake up from their slumber that this is a serious issue.
“It is not a new thing, countries like America, China, Italy, Spain, England, France and others experienced similar mysterious deaths.”
There have been concerns about the  COVID-19 cases and the increasing deaths in the state.
President Muhammadu Buhari had during the week gave a matching order to the Gwarzo-led Presidential Task Force to unravel the cause of the mysterious deaths in Kano and also to contain the spread of the virus in the state.

Some aides of President Muhammadu Buhari and other government officials, who attended the burial of Mallam Abba Kyari, have completed their 14-day isolation and tested negative for COVID-19.
Consequently, they have been reunited with their families.
There had been fears that some of them might have contracted the virus during the funeral of Kyari on April 18 at Gudu Cemetery in Abuja.
Acting Secretary, Health and Human Services Secretariat in the the Federal Capital Territory Administration, Dr Muhammed Kawu, disclosed this in a statement on Sunday in Abuja.

He said, “The Health and Human Services Secretariat of the FCT Administration is happy to announce that the individuals exposed during the burial of late Chief of Staff to the President, Mallam Abba Kyari, have completed their 14 days of isolation. Tests were conducted on them and they have all tested negative to COVID-19. They have been reunited with their families.”

Six COVID-19 Patients Discharged In Kwara

Six COVID-19 patients have been discharged in Kwara State after full recovery and testing negative twice.Rafiu Ajakaye, Chief Press Secretary to Governor AbdulRahman Abdulrazaq, made this known in a statement on Sunday.With the six patients being discharged, Kwara now has eight active cases of COVID-19.

 Ajakaye however, warned residents against letting down their guards as the level of threat of infection remains high across the country.
He said, “Effective from tomorrow Monday May 4, there will be statewide curfew between 6pm and 6am until further notice. 
“This is part of the agreement of the Northern Governors Forum to prevent non-essential and unauthorised movement that could spike infection rate. “Also, in addition to the measures earlier announced on Friday, May 1, the government hereby bans travels/movement from one local government to the other.”

Despite Owing Staff Several Months Salaries, Ifeanyi Ubah Spends Millions On Palliatives To Kickstart Gubernatorial Ambition

Senator Ifeanyi Ubah, lawmaker representing Anambra South Senatorial District at the National Assembly and Chief Executive Officer of Capital Oil and Gas, has distributed palliatives worth millions of naira to the 21 local government areas of Anambra State to kickstart his gubernatorial election.
However, Ubah, who announced the distribution on Twitter, is yet to pay salaries of his employees, some for over two years.
One of his workers, who spoke with SaharaReporters, said they were currently being owed eight months salaries and there was no indication that the money would be paid anytime soon. 

“We are owed salaries for eight months now. 
“We are suffering and he is busy showing off on Twitter all because he wants to be governor,” he said.
Another worker, who also spoke with SaharaReporters, said, “I doubt if he has good advisers. 
“He should try to pay off the over 1450 people working with him, most of whom he has owed salaries and wages for more than two years.”
A staff of Authority Newspaper, a media outfit owned by Uba, said they now borrowed money from family and friends to survive.
“My publisher, Ifeanyi Ubah, hasn’t paid us in months, if not years. We now depend on people to survive.
“Let’s not go near Capital Oil and his other companies, including his media group. 
“I saw him advertising the distribution of palliatives to 21 LGAs in his state because he wants to be a governor, very sad,” he said.

JUST IN: Adamawa Government Arrests COVID-19 Patient Who Escaped From Gombe

One of the two COVID-19 patients, who escaped from an isolation facility in Gombe State, has been arrested in Adamawa State.
Governor Ahmadu Fintiri disclosed this during a briefing with journalists in Yola, the state capital, on Sunday.
According to him, the duo escaped before results of their samples arrived from Abuja. 

He said, “One was apprehended at Lamurde through our contact tracing mechanism.
“The second suspect told us on phone that he was in Mubi but technology proved he was around Gurore in Yola South; unfortunately, his phone line is no longer going through.”
The governor added that with this development, there were now five active Coronavirus cases in the state.
He has also replaced the lockdown order he imposed last week with a curfew that will run from 8pm to 6am.
He directed civil servants from level 12 upward to resume work on Monday from 8:00am to 2:00pm.

The collision of paddle and sand in the middle of the rainy season and the receding water stain on wooden stilts attests to the impact of climate change on Makoko, a floating village sitting at the foot of the Lagos Lagoon inhabited by a fishing tribe of more than 100,000 people.

Locals say some naturally occurring fish species such as the lesser African threadfin (Galeoides decadactylus), the Senegal jack (Caranx senegallus), the West African Ladyfish (Elops lacerta) and Blue Mussels, which sold for higher prices in the market, started to disappear putting a strain on their sole source of livelihoods.

“The catch used to be enormous in the past, we use to catch all the different types of fishes then we stopped seeing Titus fish (Mackerel), Sharks that wander from the ocean seasonally, Silver Catfish and others,” said Segun Azankpo, a popular fisherman in the area.

His meagre catches are now supplemented by money he makes from lending his canoe to tourists.
A study by the Food and Agriculture Organisation of the United Nations in 2007 discovered that apart from climate change, overfishing by industrial fleets in Nigerian coastal areas such as Lagos was leading to a decline in quantity and quality of catch while also causing “environmental degradation seriously impeding the productivity of the artisanal sector and declining efficiency due to lack of technical innovation”.

In order to keep exploiting the waters for fish despite the challenges, some fishermen have turned to revenue from tourism in their community to introduce non-native species such as Bayard, African Arowana, and Grunts, which now dominate the marine wildlife in the Lagoon.

Fascinated by the allure of murky intricate waterways woven in-between makeshift wooden stilts that pale in comparison to other floating cities like Venice, foreign and local tourists seeking new adventures, YouTubers and celebrities looking to create unexplored content for their audience, are trooping into Makoko in droves, thereby providing revenue, which local fishermen in turn use to grow their fish farms.

In February 2020, World Heavyweight Champion, Anthony Joshua, visited Makoko floating slum to celebrate his victory with locals.

John Awume, a middle-aged man, who used to fish actively but now paddles tourists around while serving also as a tour guide, said he decided to pause fishing to enable him to save money to create his own fish farm with new species that yield faster and are not within the reach of foreign boats.
“I used to fish actively in the past but the yields became low and my boat developed technical problems so I became broke, my specialty used to be big fishes.
“When tourists come, they pay, even though it is not a lot but I am saving it to start my own fish farm because it is working for others around me,” he said.

The introduction of new and exotic fish species in waters where there is obvious native decline is controversial because of concerns around the conservation of freshwater biodiversity. For example, research in North-Eastern Italy shows how temporal variation in fish assemblages was analyzed over an 18-year period in 14 waterways of the lowland backwaters of the Po River, 14 native and eight exotic species were collected. In less than 20 years, 10 native species underwent local extinction.

In Zimbabwe’s Lake Victoria, the predatory Nile perch, Lates niloticus, and the herbivorous Tilapiines, Oreochromis niloticus, Oreochromis leucostictus, Tilapia zillii and Tilapia rendalii, was introduced in the 1960s due to a decline in native species. While the lake flourished and fishermen thrived through the economic opportunities it created, the lake underwent ecological changes which led to the disappearance of native species.
In Lagos, marine conservation expert, Damilola Ewuro, is calling for the regulation of artisanal fishermen on the lagoon, who are introducing non-native species as a way of protecting the natural habitat.

“In a place like Nigeria where employment is hard to come by, you have to give the fishermen kudos for their innovation in converting the tourism their community is attracting to a means of keeping the skills their forebears handed to them alive. However, there has to be massive regulation of the process.
“This regulation must come with education so as to earn the trust and cooperation of the fish farmers/fishermen who should be at the frontline of protecting the biodiversity of Lagoon,” Ewuro said.

White Bait is a common find in the Lagoon.

For now, locals like Teju Azankpo, who is a fishmonger along with the rest of her family, are enjoying the boom the new method of fish farming has brought.

Processing many large bowls of varying fish, she says she has lost count of the specific types of fish she processes every day.
“The men bring them in, plenty. We don’t ask for the names, we just clean and process. We went to school from the proceeds of the fish so I’m happy to do the work,” she said.

Another tour boat owner, Moses Stephen said, “We used to make money from making nets and selling to augment the income from the catch we used to make before people started fish farming.

“Now, we rely on the N10,000, N7,000, or N20,000 from people coming to take photos of our slum to fill that gap.
“The water where the houses are is dry and it smells. There is always dirt and pollution so no fish survives here so to start the farm, you have to move further down the Lagoon,” he said.
Farm escapees and invasive, genetic pollution, disease, parasite transfer, and habitat modification are all major concerns around the practice which calls for more studies and monitoring.
The shift from fishing native occurring species, which are fast disappearing may mean a resurgence for undisturbed biodiversity in the Lagoon. For now, residents in the floating community are happy that they can host tourists and fish in abundance again.

Do Not Attack Our Officers Enforcing Lockdown, IGP Tells Citizens, Condemn Assault On Oyo Policeman

The Inspector-General of Police, Mohammed Adamu, has cautioned Nigerians against assaulting officers enforcing the lockdown order put in place by President Muhammadu Buhari to stop the spread of Coronavirus.
Adamu also condemned the recent attack on DCO II, Eruwa Police Division, ASP Adeyemo Ogunyemi, in Oyo State, who was allegedly assaulted by a woman in a viral video.

In a statement by Force spokesperson, Frank Mba on Sunday, the IGP said the decorum maintained by Ogunyemi during the assault was commendable.
The statement reads, “Since the commencement of the COVID-19 enforcement duties, a total of 27 police personnel have suffered series of attacks and assaults from members of the public at different times and different locations.
“Many of these officers are still in hospitals receiving treatment from the injuries sustained during such attacks.
“The IGP enjoins the citizens to continue to cooperate with the police and other security personnel and voluntarily comply with all COVID-19 prevention orders.”

Creeping Tyranny In The Land Of Promise By Emmanuel Umohinyang

“We view this wicked act as not just man’s inhumanity to fellow man, but a very serious threat to our noble profession and womanhood” – Nigeria Association of Women Journalists (NAWOJ), Akwa Ibom State Council, condemning the arrest and detention of Mary Ekere, a female journalist with The Post by the state government recently.
That Nigeria is richly blessed when it comes to proverbs cannot be overemphasized.
From the North to the East, the West to South-South, you hear quality proverbs that set you thinking, any day, anytime.
Thus, no situation is so difficult or complex that Nigeria’s proverbs cannot fill the void.

It was therefore not difficult to find one while ruminating over the abyss our dear state of Akwa Ibom has fallen into under the present administration led by Governor Udom Emmanuel.
This is because, it is a clear case of descent into anarchy at every level as far as the state is concerned. The people of the state are being seen as Lamb’s in the midst of wolves. That is why the Yoruba proverb, literarily meaning when a situation gets to a more than worrisome level, the best antidote is laughter.
Who could have imagined that the same Akwa Ibom State that was the envy of all and sundry under Former Governor Godswill Akpabio would descend to this level?
Who would have thought that Akwa Ibom State which was a trail blazer in infrastructural development could return to the days of yore?
Even Akpabio would have replied “not in my life time” if anybody had predicted the situation we now have on our hands.
But something in me blames the former senator for entrusting the future of the land of promise to “a passenger in governance”.
Akpabio was too trusting. Who won’t? Here was a man who had risen to a top notch level in a foremost bank, and whom the former governor thought would surpass his legacy.
Alas, the cookie crumbled, even faster than many had thought, leaving the poor people of the state in a quandary on where the future lies.
Worse still, all manner of tactics are been deployed daily to cover what has befallen the state in recent times, even as those bold enough to speak out against the government are been hounded, using foul and unconstitutional means.
This is not expected because you are speaking about a people who have been used to quality infrastructure, running water, motorable roads, good and affordable health care, education, power and more.
It is therefore natural for such people to ask questions from the Emmanuel administration why taps have suddenly gone dry and government cannot maintain infrastructure it inherited from the previous administration.
Even maintenance of ordinary street lights are even an issue today in the state, a state which use to be well lit at night now sees that as a luxury.
Even the governor could not reel out his achievements after almost four years in office when he was asked to do so by a popular newspaper based in Lagos.
It is therefore not surprising that the government is now venting its anger on the people as a way of making them keep quiet or silence them permanently.
But the question is how long will this unenviable resort to Machiavellian tactics last in the face of bad governance, crass incompetence, lack of vision and decaying infrastructure.
Worse still, the administrations pen chance for clamping perceived opponents into jail on the slightest excuse is legendary, sometimes without any element of constitutionalism.
Many will recall how even journalists perceived to be critical of the Udom Emmanuel administration have had to be put behind bars.
The first case involving a male journalist was illegally done as usual with the legal procedure not followed at all.
The state government clamped the journalist into gulag, to take its own pound of flesh.
Even members of the opposition, activists, unionists and others have become easy prey for the administration to cover its ineptitude.
In the recent past, a female journalist, Mary Ekere, was beaten black and blue by officials of the state task force and later clamped into jail.
The journalist who was performing her constitutional duty was accused of taking photographs of the officials in Uyo while raiding an area noted for illegal street trading.
Curiously, this task force has come under severe criticism for dehumanizing citizens in the line of duty, even as some have described it as a militia and calling for its disbandment.
The female journalist spent two nights in Uyo prison and was set free after a Magistrate signed her bail bond. 
A crowd of journalists led by the Chairman of the Nigeria Union of Journalist, Akwa Ibom State Council, Amos Etuk, marched to the Uyo prison to show solidarity with the detained journalist.
“She was in tears. She was very emotional when she saw the number of Journalists who came to the prison,” Mr Etuk said
A miffed Etuk condemned the inhuman treatment meted to the Journalist and cautioned agents of Akwa Ibom government to exhibit restraint while dealing with members of the public.
Also, another journalists’ union, the Nigeria Association of Women Journalists (NAWOJ), Akwa Ibom State Council, in a statement by the Chairperson, Uduak Ekong, and Secretary, Esther Effiong, demanded apology and compensation for Ekere.
“We wish to state that the treatment meted out on our member goes against fundamental human rights of any law abiding citizen in this state.
“We therefore view this wicked act as not just man’s inhumanity to fellow man, but a very serious threat to our noble profession and womanhood.”
Late last year, it was the turn of  Michael Itok, a 21-year-old marketer with prudential microfinance bank, Uyo was not that lucky as he was also arrested and remanded in prison custody for weeks on the order of Governor Udom Emmanuel.
His offence? Allegedly publishing ‘damaging and annoying article’ on Facebook against the governor.
Also, two staff of Akwa Ibom state university, Eyo Eminne and Igno Ebong Okon would not forget Governor Udom Emmanuel administration cruelty in a hurry.
Both were arrested for demanding sixteen months unpaid salaries and defaming the governor who is a visitor to the university.
A magistrate court in Uyo which granted them bail has adjourned the case to June 8, 2020 for further hearing.
There are many other cruel and fearful unreported cases of rights abuses by the present administration in the state. But the good thing is that the entire world is watching as the situation in the state deteriorate into a fearsome dimension, even as some concerned groups are already talking.
For instance, the Socio-Economic and Accountability Project (SERAP) has lambasted Governor Udom Emmanuel over the recent arrests of Journalist in the state.
SERAP’s Deputy Director, Kolawole Oluwadare warned that those in government must not misuse power.
“We strongly condemn the arrest of Mary Ekere of the post, for taking pictures of task force officials who raided a city spot.
“State governors should immediately stop the nationwide campaign of arbitrary arrests against Journalists, activists and protesters.
“Otherwise, when state forces arbitrarily arrest, detain brave journalists and protesters like Agba Jalingo, Omoyele Sowore and Mary Ekere and continue to get away with it, they benefit from a climate of impurity”
A coalition of rights group equally dragged Governor Emmanuel before the chairman of the Peoples Democratic Party (PDP) over the scenario.
The group accused Governor Emmanuel of arresting and detaining journalists, activists, keeping them incommunicado for weeks.
The letter reads “We write to express our displeasure and condemn the insensitivity of your party, the PDP, on the rising intolerance and disturbing cases of human rights violations in some states where your party members presently hold sway.
“It is unfortunate that as the leading opposition party, which regularly condemns the lawlessness of the ruling party at the centre, some of your governors, specifically Governor Ayade and Emmanuel have chosen the odious path of intolerance while embarking on coercive campaign of arrest and arbitrary detention of social critics and political activists, perceived as enemies for being critical of their governments.”
Even COVID-19 which is currently ravaging the world has further exposed the incompetence of the authorities in Akwa Ibom State.
This is because nobody, except a clique within the state government knows the accurate figure of victims as far as the pandemic is concerned.
Politics is said to have crept into a matter that has to do with  the health of the people, with the state’s Chief Epidemiologist, Dr. Aniekeme Uwah, been redeployed for no just cause.
Even the state chapter of the Nigerian Medical Association (NMA) through its public relations officer, Dr. Emmanuel John is crying wolf and alleging a cover up, designed to save the governor from further embarrassment just the way the nationwide result on HIV/AIDs backlash.
This is the major reason concerted efforts must be made by all men and women of goodwill to stop the shenanigan, going on in Akwa Ibom State.
If we all decide to look the other way while the situation in the state gets messier, a bigger, greater and grave danger surely lies ahead. But sadly, Udom Emmanuel administration has carried on as if it has covenant with impunity, cruelty and lawlessness. 
Today, it is Akwa Ibom, nobody knows where this worrisome pendulum may swing tomorrow, hence the time to act is now.
Cry my beloved state. This cup of cruelty will surely pass over us.
